Why Drunk Driving Accidents Require Aggressive Legal Action

Drunk driving accident cases are distinct from ordinary car accident cases due to their clear-cut liability, potential for punitive damages, and the often severe injuries involved. When a driver operates a vehicle while intoxicated—whether due to alcohol, drugs, or a combination—they are in violation of New York law. This violation is not only a criminal offense but also a form of civil negligence known as “negligence per se,” which can greatly strengthen your injury claim. The law recognizes that drunk driving is reckless and inexcusable. However, insurance companies still work to minimize payouts. Our role is to protect your rights and ensure that you are compensated fairly for your suffering.

Types of DUI Accidents We Handle

Drunk driving accidents can occur in many different forms and involve a wide range of circumstances. At Billy Cooper Law, we represent clients in cases involving:

Passenger Injuries

If you were injured as a passenger in a vehicle driven by someone under the influence, you still have legal rights—even if you knew or suspected the driver had been drinking. You may be eligible to file a claim against the driver’s insurance or even a third party in some cases.

Pedestrian and Cyclist DUI Crashes

Pedestrians and cyclists are especially vulnerable in DUI-related crashes. These accidents often result in catastrophic injuries due to the complete lack of protection. We aggressively pursue full compensation for victims struck while walking or biking by impaired drivers.

Commercial Driver DUI Incidents

When a commercial driver—such as a truck driver or delivery driver—is under the influence while operating a company vehicle, both the driver and their employer may be held liable. We investigate these cases thoroughly to determine all responsible parties.

Underage and Teen Drunk Driving Cases

Crashes involving intoxicated drivers under the legal drinking age present unique legal considerations. These cases may also involve claims against the adults or establishments who provided the alcohol.

Repeat DUI Offenders and Hit-and-Run Crashes

Drivers with a history of DUI arrests who continue to drive drunk may be subject to additional civil penalties, including punitive damages. If the driver fled the scene, we work to identify them and recover compensation through uninsured motorist coverage or alternative avenues.

Injuries Sustained in Drunk Driving Accidents

The force of impact in drunk driving crashes often leads to devastating injuries. These collisions may occur at high speeds, at dangerous angles, or without any attempt by the drunk driver to slow down or avoid the crash. Common injuries include:
  1. Traumatic Brain Injuries (TBI): These may lead to memory loss, cognitive impairment, and long-term disability.
  2. Spinal Cord Injuries: Victims may suffer partial or complete paralysis, requiring lifelong medical care.
  3. Broken Bones and Fractures: Multiple surgeries and long recovery times are often required.
  4. Internal Injuries: Organ damage and internal bleeding can be life-threatening and may not be immediately apparent.
  5. Emotional and Psychological Trauma: Many victims experience anxiety, depression, PTSD, and other mental health challenges after a DUI crash.
  6. Burns, Lacerations, and Disfigurement: Fires or shattered glass can cause lasting physical and cosmetic injuries.
If you’ve suffered any of these injuries—or others—after being hit by a drunk driver, it is crucial to seek immediate medical care and legal representation.

Filing a Claim After a Drunk Driving Accident

If you’ve been injured in a drunk driving accident, taking quick legal action is essential. Acting early helps preserve evidence, protect your rights, and ensure you meet strict legal deadlines. Step 1: Gather Critical Documentation The foundation of your claim begins with strong evidence. This includes the police report, medical records, witness statements, and documentation of your damages. In DUI cases, the police report is especially valuable, often containing the driver’s blood alcohol content (BAC), results from field sobriety tests, and any related criminal charges. Step 2: Identify All Liable Parties While the drunk driver is typically the primary party at fault, liability doesn’t always stop there. Your attorney will investigate all possible sources of liability to maximize your compensation. Step 3: File the Insurance Claim After liability is determined, your attorney will file claims with the appropriate insurance companies. This includes preparing detailed documentation and handling all communications. Negotiations will begin to reach a fair settlement — but if insurers fail to offer adequate compensation, your case may move forward to litigation.

How Billy Cooper Law Supports You

At Billy Cooper Law, we take care of every aspect of your case — from collecting evidence and identifying liable parties to negotiating with insurers and going to court if needed. While you focus on your recovery, we focus on securing the compensation you deserve.

Compensation Available to DUI Crash Victims

Drunk driving accident victims may be entitled to substantial compensation. The amount depends on the severity of your injuries, the long-term impact on your life, and the conduct of the at-fault driver. Types of compensation available include:

Medical Expenses

This includes the cost of emergency treatment, surgery, hospitalization, physical therapy, prescription medications, and ongoing medical care.

Lost Wages

If you are unable to work due to your injuries, you can seek compensation for past and future lost income.

Pain and Suffering

This covers the physical and emotional distress caused by the accident and your injuries. It may include compensation for chronic pain, anxiety, depression, and loss of quality of life.

Property Damage

You may be reimbursed for damage to your vehicle or other personal property that was destroyed or damaged in the crash.

Punitive Damages

In cases where the drunk driver’s actions were especially egregious—such as repeat offenses or extremely high BAC levels—courts may award punitive damages to punish the wrongdoer and deter similar conduct.

Wrongful Death Damages

If a loved one was killed in a drunk driving accident, you may be eligible for compensation related to funeral expenses, loss of companionship, and financial support the deceased would have provided.

Frequently Asked Questions

These answers address common drunk-driving accidents questions under New York law. The facts and applicable rules can change the answer. This is general information, not personal legal or medical advice.

Does a DWI charge automatically win the injured person’s civil case?

No. A criminal charge or conviction can be important evidence, but a civil claim still requires proof of responsibility, causation, injury, and damages. Criminal and civil proceedings use different parties and standards.

Preserve police and court information, but do not wait for the criminal matter to end before protecting civil deadlines and evidence.

Can alcohol impairment matter when a driver’s BAC was below .08?

Yes. VTL §1192 separately prohibits driving while ability is impaired by alcohol, and NHTSA explains that alcohol can affect driving ability below .08. A BAC number is evidence, not the complete civil-liability analysis.

Driving behavior, timing, testing, observations, and other substances may matter. Avoid drawing medical or legal conclusions from one number without the full record.

Can a bar or restaurant be responsible for a drunk-driving crash?

Potentially. General Obligations Law §11-101 creates a claim against a person who unlawfully sold or assisted in procuring liquor and thereby caused or contributed to the intoxication that produced injury.

This is not automatic social-host liability. Evidence about the sale, patron, apparent condition, timing, and causal connection must be investigated promptly.

Can I pursue a claim if the driver is not convicted of DWI?

Potentially. A civil claim does not always depend on a criminal conviction. Evidence may still support negligent or impaired driving even if charges are reduced, dismissed, or never filed.

Obtain available reports, witness information, video, and vehicle evidence through lawful procedures. The absence of a conviction does not prove either civil liability or no liability.

Does no-fault insurance still apply when the other driver was drunk?

For an eligible occupant, no-fault is generally the first source for covered economic losses regardless of who caused the collision. The liability claim against an impaired driver is separate.

Submit timely no-fault notice while preserving evidence against responsible parties. A DWI allegation does not eliminate the serious-injury rules for a covered non-economic claim.

Sources: NY DFS: Consumer questions about no-fault insurance; NY Insurance Law §5102: no-fault and serious-injury definitions; NY Insurance Law §5104: limits on covered motor-vehicle claims.

Are punitive damages automatic in a drunk-driving case?

No. Punitive damages are exceptional and require facts satisfying the governing standard; intoxication allegations do not create an automatic award. Compensatory damages still require proof of actual losses.

The conduct, surrounding circumstances, and admissible evidence must be evaluated. Do not include punitive damages in a settlement estimate as guaranteed money.

Sources: NY CPLR §4111: past and future injury damages; NY Vehicle and Traffic Law §1192: alcohol- and drug-impaired driving.

What evidence should be preserved after a suspected drunk-driving crash?

Keep the crash report, witness contacts, photographs, video, insurer communications, and medical records. Note the officer agency and court information, and identify nearby businesses or cameras quickly.

Additional alcohol-service or toxicology records require lawful preservation and discovery. Do not confront a driver or business or post accusations online to collect evidence.

Sources: New York DMV: Order and access crash reports; U.S. HHS: Your medical records; NY General Obligations Law §11-101: unlawful alcohol sales.

What if the injured driver also made a driving mistake?

The applicable fault rule must be assessed. In an Article 51 personal-injury action, current CPLR §1411(b) can bar recovery when the claimant’s fault exceeds the opposing parties’ combined fault; otherwise fault may reduce damages.

The other driver’s intoxication does not erase every question about causation. The 2026 amendment applies based on when the action is commenced.

Sources: NY CPLR §1411: comparative fault; Enacted 2026 budget, Part EE: applicability of motor-vehicle changes.

Does the criminal case extend the civil filing deadline?

Do not assume so. Many negligence actions have a three-year period, while public-entity, wrongful-death, no-fault, and other claims use separate deadlines.

A criminal investigation can proceed on a different schedule. Protect evidence and obtain civil deadline advice promptly instead of waiting for sentencing or dismissal.

Sources: NY CPLR §214: personal-injury filing periods; NY EPTL §5-4.1: wrongful-death action and filing period; NY General Municipal Law §50-e.

How is a drunk-driving injury claim valued?

Value depends on supported liability, medical causation, treatment, prognosis, earnings effects, future needs, and pain and suffering where available. A high BAC or criminal charge is not a settlement formula.

Potential additional defendants and punitive damages require evidence. Review insurance, liens, fees, expenses, and the release before accepting an offer.
